Summary module description:
This module provides students with knowledge of the legal principlesÌýof property law relevant to a real estate professional. ItÌýcovers theÌýfoundational conceptsÌýof land law, including the rules relating to the transfer of land. It also dealsÌýwithÌýthe rights and obligations arising from leasehold ownership.Ìý
Aims:
This moduleÌýaims to provide students with a knowledge and understanding of the legal framework for freehold and leasehold ownership and with a sound grasp of how the rules governing the use, enjoyment and transfer of leasehold property operate in a practical and commercial context.Ìý
Assessable learning outcomes:
Upon completion of this module, students should be able to:
demonstrate a practical understanding of the basic principles of the law governing estates and interests in land and their acquisition;Ìý
demonstrate a critical awareness of how these principles impact on the ownership and occupation of real estate;Ìý
enumerate and understand the principal liabilities, obligations and rights between landlords and tenants and the remedies for breaches of covenant;Ìý
explain and evaluate the way in which the lawÌýprotects the occupation of tenants of business premises;Ìý
identify and analyse potential legal rights and liabilities arising out of complex hypothetical scenarios;Ìý
organise and deploy legal material concisely and effectively in writing.Ìý

Students will be encouraged, through guided discussion, to furtherÌýdevelop their oral communication skills and their effectiveness in group situations.Ìý
Outline content:
- foundational legal principles including an introduction to the English legal system;Ìý
- the key principles of English landÌýlaw;Ìý
- leases, licences and the enforceability of leasehold covenants;Ìý
- the principal lease covenants;Ìý
- remedies for breach of lease covenants;Ìý
- termination of leases;Ìý
- rent reviews; andÌý
- statutory protection ofbusiness tenants.Ìý
Brief description of teaching and learning methods:
The moduleÌýwill be delivered as a block release with on-line moduleÌýsupport. The block release teaching will compriseÌý4 daysÌýof lecturesÌýandÌýproblem solvingÌýworkshops. Two individual project assignments will serve to consolidate and integrate the taught material.Ìý
The block release taught element will be supportedÌýby the use ofÌýBlackboard. The course information, handouts, presentations and assignmentsÌýwill be posted h ere.Ìý

The module will be assessed by way of two assignments. These will require students to consider a hypothetical scenario or scenarios, to identify the legal issues arising therefrom, and to suggest possible legal outcomes. A word guide of 2,000Ìýwords applies to the first assignment and one of 3,000 to the second. The first assignment is weighted at 40% of the module mark; the second assignment is weighted at 60% of the module mark.Ìý

Penalties for late submission:
The Support Centres will apply the following penalties for work submitted late:Ìý
- where the piece of work is submitted after the original deadline (or any formally agreed extension to the deadline): 10% of the total marks available for that piece of work will be deducted from the mark for each working day (or part thereof) following the deadline up to a total of five working days;Ìý
- where the piece of work is submitted more than five working days after the original deadline (or any formally agreed extension to the deadline): a mark of zero will be recorded.Ìý
