Summary module description:

This module is designed to help students develop a conceptual understanding of the legal environment in which real estate operates in the UK.Ìý


Aims:

Students will gain a systematic appreciation of how property law shapes the rights and obligations which attach to owners and occupiers of real property in England and Wales. It also aims to provide students with a knowledge and understanding of the legal principles governing the use, enjoyment and transfer of freehold and leasehold land and to set these in their practical and commercial contexts.Ìý


Assessable learning outcomes:

Upon completion of this module, studentsÌýshould be ableÌýto:Ìý





  • demonstrate a practical understanding of the basic principles of the law governing estates and interests in land and their acquisition;Ìý




  • demonstrate a critical awareness of how these principles impact on the ownership and occupation of real estate;Ìý




  • enumerate and understand the principalliabilities, obligations and rights between landlords and tenants and the remedies for breaches of covenant;Ìý




  • explain and evaluate the way in which the lawÌýprotects the occupation of tenants of business premises;Ìý




  • identify and analyse potential legal rights and liabilities arising out of complex hypothetical scenarios;Ìý







  • organise and deploy legal material concisely and effectively in writing.Ìý

Students will be encouraged, through guided discussion, toÌýfurtherÌýdevelop their oral communication skills and their effectiveness in group situations.Ìý

  • Estates and interests in land and their acquisitionÌý




  • Easements and freehold covenantsÌý




  • The protection of interests in land and overriding interestsÌý




  • Leases, licences and the enforceability of leasehold covenantsÌý




  • The principal leasehold covenantsÌý







  • Remedies for breach of covenantÌý




  • Commercial rent reviewÌý




  • Statutory protection of business tenants.Ìý
