Summary module description:
This module introduces the main aspects of landlord and tenant law including types of leases, covenants and the processes encountered by surveyors in relation to landlord and tenant legal interaction.
This module is delivered at the °ÄÃÅÁùºÏ²Ê¿ª½±¼Ç¼ and the °ÄÃÅÁùºÏ²Ê¿ª½±¼Ç¼ Malaysia.Ìý
Aims:
The module aims to provide students with an understanding of the main legal principles and issues applying to landlord and tenant law. This builds on the foundations created in the Introduction to Property Law module in the first year and runs alongside the Part 2 Planning Law and Practice moduleÌý
Assessable learning outcomes:
Upon completion of this module, studentsÌýshouldÌýbe able to:Ìý
- demonstrate a practical understanding of the principles of the law governing the relationship between landlords and tenants in the commercial property market;Ìý
- enumerate and understand the principal liabilities, obligations and rights between landlords and tenants;ÌýÌý
- understand how commercial leases can beÌýbrought to an endÌýand e valuate the remedies available for breaches of covenant;Ìý
- explain and evaluate the way in which statute protects the occupation of tenants of business premises;Ìý
- identify and analyse potential legal rights and liabilities arising out of complex hypothetical scenarios;Ìý
- organise and deploy legal material concisely and effectively in writing.Ìý

The understanding of students will be developed largelyÌýthrough the use ofÌýlegal questions and problems which will requireÌýtheÌýknowledgeÌýandÌýskills of students to be applied to a variety of hypothetical situations arising out of landlord and tenant law.Ìý
The lectures aim to cover the main principles of the relevant materials. The lectures will be supplemented by handouts which will also note some areas not covered in the lectures. In tutorials, the relevant material will be discussed in more detail than is possible in lectures.Ìý

The module covers the following areas:Ìý
- Classification of leases and tenancies.Ìý
- Enforcement of leasehold covenants under statute.Ìý
- Implied covenants.Ìý
- Procedure for obtaining consent to theÌýalienationÌýof a lease and grounds on which consent to suchÌýalienationÌýcan be refused by landlords.Ìý
- Principal rules relating toÌýalterations, repairs, insurance Ìýand changes of useÌýto leased property.Ìý
- Termination by forfeiture of leases.Ìý
- Main principles of rent review.Ìý
- Main principles of statutory renewal of business tenancies.ÌýÌý
Brief description of teaching and learning methods:
There will be 1 xÌý1-hourÌýlecture and 9 x 2-hour lectures plus 4 tutorials which involve advance reading and preparation. There will also be a revision lecture.Ìý

Summative assessment- Examinations:
Two-hourÌýexamination paper requiring students to answer three questions from a choice of six topics.Ìý
Summative assessment- Coursework and in-class tests:
Formative assessment methods:
- One piece of non-assessed coursework answering an exam-style question.Ìý
- One mock examination in the same style and format as the summative examination.
Penalties for late submission:
The Module Convenor will apply the following penalties for work submitted late, in accordance with the University policy:Ìý
- where the piece of work is submitted up to one calendar week after the original deadline (or any formally agreed extension to the deadline): 10% of the total marks available for the piece of work will be deducted from the mark for each working day (or part thereof) following the deadline up to a total of five working days;
- where the piece of work is submitted more than five working days after the original deadline (or any formally agreed extension to the deadline): a mark of zero will be recorded.

You are strongly advised to ensure that coursework is submitted by the relevant deadline. You should note that it is advisable to submit work in an unfinished state rather than to fail to submit any work.
